TERMS AND CONDITIONS FOR DRESDNER CHAUFFEUR SERVICE 8 X 8 GMBH
The following terms and conditions (hereinafter “Terms”) apply to all passenger and goods transport services provided by the company Dresdner Chauffeur Service 8 x 8 GmbH, Ostra-Allee 18–20, 01067 Dresden (hereinafter “DCS”). The version of these Terms that is currently valid shall be displayed in a clearly visible manner in the premises of DCS and available to read in DCS vehicles on request. Use of our services constitutes binding acceptance of our conditions.
Any alternative conditions provided by the customer shall not be recognised unless DCS expressly agrees to their validity.
- Conclusion of contract, booked trips
2.1 The description of the services and conditions set out on the website www.8mal8.de do not constitute binding quotations: rather, they are an invitation to submit a booking request. A binding booking is only made, and/or a contract of carriage is only concluded, if DCS either confirms the customer’s booking request in advance (e.g. in writing, by text message or by e-mail) or if the customer actually sets out on the trip.
2.2 In the case of booked trips, including, but not limited to, trips to the airport, railway station or port, or pick-ups from the airport, railway station or port, a specific pick-up time can be agreed upon. The customer must provide sufficient notice in the case of changes to the specified pick-up time due to delays etc. Otherwise, the customer shall be liable for any costs incurred by DCS. In the case of delays caused by the baggage reclaim process, lost luggage, customs clearance or technical problems, DCS grants a grace period of 15 minutes.
No guarantee can be provided that the driver will wait longer. If the driver does wait longer, a fee will be added to the fare for every 15 minutes or part thereof, in line with the basic hourly price.
- Cancellation conditions
Trips booked with a pick-up address in Dresden can be cancelled free of charge up to 24 hours before the agreed pick-up time. Trips booked outside Dresden and within Germany can be cancelled free of charge up to 48 hours before the original pick-up time. In the case of later cancellations or no-shows, a cancellation fee will be charged equivalent to the booking value.
- Prices, payment and settlement
4.1 Unless otherwise stated, all prices are understood to be in euros and to include statutory VAT and any fees payable for using the routes (e.g. ferries, tunnel tolls, etc.).
The fare shall be paid immediately after the trip has been completed, in cash. Debit card or credit card payments are also accepted in all vehicles. Agreements on alternative terms may be made in writing. If payment on receipt of invoice is agreed upon, payment shall be made within 7 days of receiving the invoice.
4.2 Discounts based on proof of entitlement (e.g. SZ bonus card, etc.) are only valid if proof is presented before the trip begins.
4.3 The customer is not entitled to withhold any payment based on any counter-claims, or to offset it against any pecuniary claims against DCS. This shall not apply to claims that are undisputed, that DCS recognises, or that have been legally established as valid. However, the customer is only entitled to withhold payment in the case of counter-claims arising from one and the same contractual relationship.
- Other agreements
5.1 Customers shall treat DCS vehicles with care. Smoking is prohibited in DCS vehicles. The customer is obliged to wear a seat belt while the vehicle is moving.
5.2 Food shall only be carried in closed containers. During the trip, such containers may not be opened and alcohol or food may not be consumed without the explicit consent of DCS.
5.3 During carriage, any accompanying baggage and animals being transported are in the customer’s care. Animals may not be kept on seats. The customer is liable for damage caused by accompanying animals.
5.4 The customer must pay DCS in full for any soiling or damage of any kind that the customer causes in or to the vehicles.
5.5 DCS is free to choose the vehicle and its features. The customer shall draw attention to any special transport requests, including, but not limited to, those due to health requirements.
5.6 When the fare is calculated by the kilometre, the route on which it is based shall, at the customer’s request, be determined with the customer before the trip begins; when the fare is not calculated based on kilometres travelled, inter alia in the case of shared bookings, DCS may select the route at its convenience. Every customer has the opportunity to select the route at his or her convenience. Stops can be made en route, but these must be specified when booking. 10.00 euros including VAT will be charged per stop en route. DCS shall take the customer’s request into account while complying with the German Road Traffic Regulations (StVO) and ensuring the safety of all passengers and other road users.
5.7 When accepting goods suitable for courier delivery, DCS shall check whether the delivery is complete on the customer’s instructions and behalf. The customer shall provide written confirmation of such goods’ receipt when accepting them. DCS shall load and secure goods for courier delivery in a suitable manner. If, when such goods are delivered, the inspection reveals a shortage or shortcoming compared to the acceptance confirmation, this must be reported to DCS in writing, detailing the nature and scope, immediately upon delivery.
6.1 DCS is liable for damage arising from injury to life, body or health in accordance with legal provisions.
DCS shall not be liable for any other damage unless such damage is due to an intentional or grossly negligent breach of duty on the part of DCS, or to DCS violating its cardinal obligations. Where cardinal obligations are violated, any claims for damages by the customer are limited to damage typically foreseeable in respect of the contract.
6.2 DCS may not be held to account for delays in the provision of services caused by force majeure or events that make the trip more difficult (e.g. the air conditioning breaking down en route) or make it considerably more difficult or impossible (including, but not limited to, vehicle breakdowns, force majeure, congestion due to the weather or accidents, etc.).
6.3 DCS explicitly assumes no liability for items and valuables belonging to the customer that are left behind in vehicles.
- Data protection
DCS shall collect and store the data required to carry out the business transaction. DCS shall comply with legal provisions when processing personal data. Please see the separate privacy statement.
- Final provisions
8.1 If any individual provisions of these Terms are or become void or ineffective, the validity of the remaining provisions of these Terms shall remain unaffected. In all other respects, statutory provisions shall apply. Alterations and additions to these Terms must be made in writing.
8.2 German law exclusively shall apply to the legal relationship between DCS and the customer. The place of jurisdiction for all disputes arising from the contract of carriage is Dresden.
